COTREP is pleased to welcome you to the « www.cotrep.fr » website (hereinafter referred to as « the Site »), intended forin order to inform them about the French plastic packaging recycling channels and support them in the assessment of the recyclability of packaging.
The Site allows you to find general information on plastic packaging recycling channels, to find out about the eco-design rules for plastic packaging and to request COTREP to assess the recyclability of plastic packaging intended for the French market. It also provides access to the following resources: eco-design recommendations for recyclable plastic packaging, opinions or results of technical studies posted online by COTREP, and a contact link to COTREP to answer specific questions about the recyclability of plastic packaging.
The purpose of the General Terms and Conditions of Use is to define the conditions under which COTREP allows Users to access and use the Site. They are applicable from the time they are put online and for the entire duration of the provision of the Site by COTREP.
The use of the Site by the User is free of charge, except for the cost of the internet connection, which remains at the User’s expense.

ACCEPTANCE
Any use of the Site implies pure and simple acceptance by the User of these General Terms and Conditions of Use and their content.
Acceptance of the General Terms and Conditions of Use conditions conditions the granting free of charge of a revocable, non-exclusive, non-assignable, non-transferable, personal, non-sublicensable right, to use the Site for an indefinite period and for the entire world. COTREP reserves the right to unilaterally modify, at any time and without notice, all or part of these General Terms and Conditions of Use as well as certain functionalities, in particular for technical reasons. The amended Terms and Conditions of Use are effective from the date of publication.
Any use of the Site after modification of these General Terms and Conditions of Use constitutes pure and simple acceptance by the User of the new General Terms and Conditions of Use. It is therefore the User’s responsibility to regularly consult these General Terms and Conditions of Use to become aware of the terms and conditions in force.
The User undertakes, on behalf of himself and his employees, to use the Site only for the purposes described in these General Terms and Conditions of Use. Any use of the Site for purposes other than those mentioned herein is strictly prohibited and may be sanctioned notwithstanding any claim for damages that may be claimed by COTREP members. In particular, the User undertakes to use the information available on the Site in a lawful and fair manner and not to fraudulently access the Site or disrupt its operation.
TERMS OF ACCESS AND USE
The use of the Site is subject to:

- The existence of a sufficient Internet connection from the User’s terminal,

The equipment and material means allowing access to the Site are the exclusive responsibility of the User. In particular, the User is responsible for the costs incurred in accessing, consulting and using the Site and is responsible for any necessary adaptation of his computer system for the use of the Site.
The total or partial impossibility of using the Site, in particular due to the incompatibility of the terminal or browser, cannot give rise to any compensation or liability on the part of COTREP.
The User shall refrain from any use not explicitly provided for in the General Terms and Conditions of Use, and in particular from modifying the Site or extracting information or data from it.
The User undertakes to:
- Use the Website in accordance with the regulations in force, public order and these General Terms and Conditions of Use
- Not to use the Site in a fraudulent or illegal manner;
- Not to infringe the rights of third parties, in particular to respect the intellectual property rights of COTREP members or third parties (images, videos, sounds or any other protected element) to which he/she will have access as a result of the use of the Site;
Make personal use of the Site and not to exploit the Site for commercial purposes;
Provide only true and strictly necessary information when making contributions and not make erroneous reports about the content accessible on the Site.
The User is responsible for all damages caused by him or her as a result of the use of the Site. It guarantees the co-publishers of the Site against any request or claim from third parties who would invoke a violation of their rights following the use made by the User of the Site.
The User shall indemnify the co-publishers of the Site for any prejudice, damage, loss or costs (including attorneys’ fees) related to any request, action, complaint or claim due to non-compliance with these General Terms and Conditions of Use.
INTELLECTUAL PROPERTY RIGHTS
The entire Site and its content are subject to French legislation on copyright and intellectual property (designs and models, trademarks, databases) and are protected as such.
All content of the Site (architecture, graphic charter, texts, titles, photographs, sounds, images, illustrations, animated sequences with or without sound, software, etc.) is the exclusive property of the co-publishers or their service providers and/or partners who have authorized the co-publishers to use and/or exploit them.
All rights of reproduction, representation and adaptation as well as extraction and reuse of data are reserved, including for downloadable documents and iconographic and photographic representations.
In accordance with the Intellectual Property Code, any representation, reproduction, modification, distortion, total or partial extraction of the pages, data and any other constituent element of the Site, by any process or medium whatsoever, including downloadable documents and iconographic and photographic representations is prohibited and constitutes, without the prior authorisation of the publisher or the rights holders, an offence of counterfeiting may incur the civil and criminal liability of its author.

SITE SECURITY AND AVAILABILITY
Access to the Site is open 24 hours a day, 7 days a week. COTREP makes its best efforts to ensure the continued accessibility of the Site and its proper functioning.
COTREP will make every effort to ensure its general obligation to protect and secure the Site and the data that make it up. However, the User admits that he/she is aware of the limitations specific to the Internet network and acknowledges the impossibility of a total guarantee of security of data exchanges against the risks of misappropriation or piracy.
The members of COTREP cannot guarantee that the operation of the Site will be uninterrupted and/or that its content is free of any error.
Users are informed that the Site may be suspended without notice for maintenance operations and data updates necessary for its proper functioning. COTREP may also remove the Site in the event of obsolescence or unsuitability of the Site or a decision to abandon its operation for any other reason whatsoever. This closure of the Site will not give rise to any right to any damages for Users.
COTREP members cannot be held liable for malfunctions and/or interruptions of the Site resulting from the operations carried out by the User, or in the event of an interruption resulting from any external cause, such as in particular the interruption resulting from a lack of power or power supply, or an interruption of Internet connection.
COTREP members reserve the right to take any action in accordance with the preservation of their interests against the User who is the cause of a breach of these General Terms and Conditions of Use or a security problem.
RESPONSIBILITY
COTREP members will only be liable, under a general obligation of means, for direct material damage proven by the User and resulting from a non-compliance of the Site with the principles presented in these General Terms and Conditions of Use.
In addition, the co-publishers shall not be liable under any circumstances for indirect material damage or direct and indirect immaterial damage resulting from the use of the Site, the loss, alteration, deletion of elements and/or documents or fraudulent access to the User’s confidential data or information.
Indirect damage shall be understood in particular: lost earnings, loss of brand image, corruption or loss of files, data or computer programs that could result in particular from a failure or use of the Site. Any action brought against the User by a third party is considered to be indirect damage and therefore does not give rise to the right to compensation.
COTREP members, their managers or employees may not be held liable for any damage, direct or indirect, commercial or not, resulting from:
Connection to and use of the Site (bugs, errors, inaccuracies, omissions in the information available, lack of availability of features, etc.);
Any interruption or unavailability of the Site in whole or in part for any reason whatsoever, in particular due to maintenance operations or technical problems;
Use of the Site that does not comply with the General Terms and Conditions of Use or the law;
User errors such as entering false or erroneous data;
A fraudulent intrusion by a third party resulting in a modification of the information made available on the Site.
Similarly, COTREP members cannot be held liable for events due to an event of force majeure, breakdowns and technical problems concerning the hardware, programs and software or the Internet network that may lead to the suspension or termination of the Site.
In addition, COTREP does not guarantee that the server hosting this site is free of viruses or that there may be a technical problem that interferes with the normal use of the Site.
COTREP reserves the right to modify, suspend or interrupt the distribution of all or part of the Site.
In particular, COTREP members will not be liable for any damage caused by:
The User’s own act, omission or fault (e.g. misuse, incorrect configuration of the terminal, use of an obsolete browser, etc.);
Any third party not related to COTREP (for example, in the event that problems result from the performance, congestion or connection of telecommunications means or services, or the performance of the User’s computer equipment).
The User acknowledges that he or she is solely responsible for using the Site and must verify the accuracy, relevance and consistency of the information and data available on the Site. The use of the information and data on the Site and any decisions made on the basis of this information and data will be the sole responsibility of the User.

COTREP members reserve the right to take legal action against persons acting in a manner that may be considered illegal or unlawful or in breach of these Terms.
Any dispute relating to the interpretation, formation, performance or termination of these Terms and Conditions of Use is a prior attempt at amicable settlement between the parties.
In the absence of an amicable settlement, the dispute may be brought before the competent court within the jurisdiction of Paris.
