Directive 94/62/EC on packaging and packaging waste (European Parliament and Council, December 20th, 1994) sets essential requirements for packaging marketed in the European Community.
The requirements include prevention by at-source reduction and packaging recoverability.
More recently, Parliament and Council Directive 2004/12/EC amended Directive 94/62/EC on February 11th, 2004 by setting target dates for new member states and new recycling rates for plastic packaging.
In France, Directive 94/62/EC was transposed in Decree 98-638 of July 20th, 1998. This one has been abrogated by the Decree 2007-1467 of October 12th, 2007. Its content has been reclassified in the 5th book (regulation part) of the environment code.
